ORDER : The Court made the following order :- The petitioners/accused Nos.1 to 3, who apprehend arrest at the hands of the respondent police for the offence punishable under Section 379 IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act 1957, in Crime No.64 of 2022 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the petitioner has illegally transported 61 gunny bags in which the river sand was loaded. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioners are innocent and they have been falsely implicated in this case.

4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioners have transported 61 gunny bags in which river sand loaded and he further submits that A1 is having four previous cases and A3 is having three previous cases.

5.Considering the facts and circumstances of the case and also considering the nature of the offences levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
