PRAYER :- For Bail in Crime No.129 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded judicial custody on 01.05.2022 for the offences punishable under Section 174 Cr.P.C. r/w Section 306 of IPC, in Crime No.129 of 2021, on the file of the respondent police, seek bail.

2.The case of the prosecution is that the defacto complainant is the brother of the deceased. The deceased borrowed an amount from his friends and handed over the same to other persons including the petitioner. The said amount was not repaid to the deceased properly. Hence, the deceased committed suicide. Hence, the case has been registered.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case.

4.The learned Additional Public Prosecutor for the respondent police submits that the suicide note revealed that the petitioner, who borrowed the amount from the deceased refused to repay the same. For that only, he suffered with mental stress and decided to commit suicide. A copy of the suicide note has also been produced before this Court.

5.There are totally four accused and one of the accused was granted anticipatory bail as if no specific overt act has been attributed against him. As per prosecution, the deceased committed suicide because of the petitioner, which requires detail investigation. If the petitioner is released on bail, he may abscond and tamper the witnesses. Therefore, this Court is not inclined to grant bail to the petitioner.
