ORDER

The present transfer civil miscellaneous petition is filed to transfer H.M.O.P.No.427 of 2024, on the file of the Sub Court, Rajapalayam to the Family Court, Tirunelveli. 1/4

2.The reason cited by the petitioner is that the distance is more than 150 kilometers. Since the petitioner has to take care of her son who is studying 12th standard and also elders, she is seeking to transfer the H.M.O.P.No.427 of 2024, on the file of the Sub Court, Rajapalayam to the Family Court, Tirunelveli.

3.The learned Counsel appearing from the respondent submitted that since in Tirunelveli, it is a Family Court, daily appearance is necessary. If it is a Sub Court, it would be convenient for the petitioner to appear.

4.Therefore, considering the rival submissions, this Court is of the considered opinion that H.M.O.P.No.427 of 2024, on the file of the Sub Court, Rajapalayam shall be transferred to the Sub Court, Sankarankovil. 5.With the above directions, the transfer civil miscellaneous petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
