Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the respondent police not to harass the petitioner on the guise of enquiry except through due process of law.

ORDER

This petition is filed by the petitioner to direct the second respondent not to harass the petitioner under the guise of enquiry except due process of law.

2. According to the petitioner, based on the complaint lodged by the third respondent regarding the money dispute, the second respondent frequently called the petitioner without valid reason, to that effect, the petitioner sent a representation on 04.04.2025, but no action was taken. Hence, this petition.

3. The learned Additional Public Prosecutor (crl.side) appearing for the respondents 1 and 2, on instructions, submits that already petitioner gave complaint against the third respondent, in which, enquiry was conducted and closed. Now, the third respondent lodged a complaint against the petitioner, for which, CSR No.56 of 2025 was assigned and the same is pending for enquiry, apart from that , they have not harassed the petitioner. The petitioner was called only for enquiry purpose.

4. Considering the prayer sought for in this petition, this Court, without issuing notice to the third respondent, is inclined to pass order. 2/4

5. According to the petitioner, the respondent police are harassing him based on the complaint lodged by the third respondent. In this regard, she already sent a representation on 04.04.2025. According to the respondent police, they denied the harassment as alleged by the petitioner and they submits that based on the complaint lodged by the third respondent, they called the petitioner for enquiry purpose only. Therefore, this Court directs the second respondent to conduct enquiry on the third respondent's complaint along with the petitioner's representation dated 04.04.2025 and dispose of the same, in accordance with law, within 15 days from the date of receipt of a copy of this order.

6. with the above direction, this Criminal Original Petition is disposed of.
