ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under Sections 279, 294 (b), 324 and 307 of I.P.C., in Crime No.88 of 2018, on the file of the respondent police, seeks anticipatory bail.
2. The petitioner had caused an accident leading to grievous injuries to one Muthumari.
3. The learned counsel appearing for the petitioner undertakes that the petitioner will pay a sum of Rs.10,000/- to the said Muthumari as an interim compensation. He further submitted that the auto is having proper insurance.
4. Therefore, the jurisdictional Magistrate is directed to instruct the local Legal Services Authority so that the a claim can be filed on the side of the victim before the Motor Accidents Claim Tribunal, Ramanathapuram District.
5. Recording the said undertaking given by the learned counsel for the petitioner, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, https://hcservices.ecourts.gov.in/hcservices/
Rameshwaram, and executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
