PRAYER :- For Anticipatory Bail in Crime No.5 of 2022 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A7, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 420 and 506(i) of IPC in Crime No.5 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant's son and one Parthiban's daughter were studying in the same school namely S.R.V.Public School, Samayapuram, Trichy District and thereby, the defacto complainant and the said Parthiban were got introduced among each other and both of them were entered into friendly relationship. On that strength, the said Parthiban asked the defacto complainant to invest in the real estate business in the name of Sparrow Global Trade and also introduced Sparrow Reality https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.7012 of 2023 situated at Mannarpuram, which is the part of "Sparrow Global Trade". The defacto complainant believed the words of said Parthiban, he and his wife had invested money to the said firm and they also introduced several persons to the aforesaid companies to invest in the companies. So far, they deposited in the said companies to the tune of Rs.5 Crores. Thereafter, the accused persons cheated them. Hence, the complaint.
3. The learned counsel for the petitioner submitted that even as per the FIR there is no specific allegation as against the petitioner. The only allegation is that the petitioner threatened the depositors.
4. It is seen that A1 to A3 running eight companies in various names. First company by name Sparrow Global Trade. Subsequently, they had floated so many companies and collected more than Rs.5 crores from 36,000 victims. That apart, now the offences were also altered into TANPID Act. Further, the petitioner also involved in four similar cases and as such, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
