ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offence punishable under section 379 of IPC, in Crime No.43 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with other accused persons have stolen the car of the defacto complainant bearing registration No.TN-67, BD-3888. Hence, a complaint has been registered.

4. The learned counsel appearing for the petitioner would submit he is an innocent person and he did not commit any offence as alleged by the prosecution. Hence, he seeks anticipatory bail.

5. The learned Government Advocate (criminal side)appearing for the respondent police would submit that the petitioner is a habitual offender and that there are 9 previous cases are pending against the petitioner in similar offence.

6. Taking note of the submission of the learned Government Advocate (criminal side) and considering the fact that the petitioner is a habitual offender and 9 previous cases are pending against the petitioner and hence, this Court is not inclined to grant anticipatory bail.

7. Accordingly, the Criminal Original Petition stands dismissed.
