Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the petitioner's online application and representation dated 24.11.2025 and thereby consequently direct the respondent authorities to renew the passport bearing No. T3678186, within the time frame stipulated by this Court and thus render justice.

ORDER

The petitioner is before this Court seeking a direction for the respondent to consider the petitioner's online application and representation dated 24.11.2025 for renewal of passport in favour of her minor son. The said application has not been processed citing that the father has not given consent for issuing passport in favour of the petitioner's minor son.

In identical circumstances, Co-ordinate Bench of this Court in W.P(MD)No.24403 of 2025 vide order dated 10.09.2025 following the judgment viz., Zaynab Aaliyah Mohamed vs.The Union of India (W.P.No. 25962 of 2024) considered the earlier judgment of that Court in L.Deepika vs. Union of India and the judgement of the Kerala High Court in Juvairiya Vs. Regional Passport Officer and in Chaitanya S.Nair vs. Union of India had issued the following directions:

(i) The petitioner shall appear before the respondent authority on 17.09.2025 or on any other date subsequently notified by the said authority;

(ii) The petitioner shall submit such affidavits and annexures as may be required by the authorities in terms of the aforementioned judgment.

(iii) Upon furnishing the same, dehors the fact that the petitioner's husband has not signed the passport application, the application for the issue of the passport shall be considered by the respondent and the passport shall be issued in favor of the petitioner's daughter, Dhanashree; (iv) The said exercise shall be completed within a period of two weeks from the date of the petitioner's appearance and execution of documents before the respondent authority. No costs."

3.Therefore, this Writ Petition is disposed of in terms of the aforesaid order. The petitioner shall submit such an affidavit and annexures as may be required by the authorities and upon furnishing the same, dehors the fact that the petitioner's husband has not signed passport application for renewal of passport shall be considered by the respondent and the passport shall be issued in favour of the petitioner's minor son namely, Harwin Mukilan. No Costs.

4. The said exercise shall be completed within a period of two weeks from the date on which the petitioner furnishing the documents before the 3/5

respondent authority. No costs.
