ORDER
The writ petition has been filed in the nature of mandamus seeking a direction to the respondents / the Tahsildar and the Taluk Surveyor, Taluk Office, Madurai South Taluk, Madurai District, to conduct survey and fix four boundaries with respect to property in Survey No.50/5B1A measuring 0.38.99 ares in Nedungulam Village, Madurai South Taluk, Madurai District.
2. In the affidavit filed in support of this writ petition, it had been stated that the father of the petitioner, Kannandi and two others Santhosam and Arumugam had purchased the aforementioned land by a sale deed dated 05.03.1998, registered as Document No.1333/98 registered before the Joint Sub Registrar, Madurai. A Joint patta was also issued in the name of the father of the petitioner and Santhosam and Arumugam. The father of the petitioner died on 08.04.2012. His legal heirs are the petitioner, the mother of the petitioner Karuppayee and sisters of the petitioner Sangeswari, Maheswari and petitioner's brothers namely Palanimurugan, Pothuraja and Sathyamoorthy. The petitioner claims that the survey of the land is required.
3. Let notice be issued to all the family members of the petitioner and also to Santhosam and Arumugam, S/o. Kathaan and thereafter in their presence 2/4
if there are no objections, the respondent may conduct survey of the land aforementioned. The entire exercise may be conducted within a period of eight weeks from the date of receipt of a copy of this order.
