Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the first respondent police to grant police protection to the petitioner and his family members life and property in constructing wall in his lands to the extent of 6 cents at S.No.96/1B in Athiyur Village & Group, Thiruvadanai Taluk, Ramanathapuram District based on the representation, dated 06.06.2016.

ORDER

The petition is filed seeking direction to the first respondent to grant police protection to the petitioner. 2.Mr.K.Rajeswaran, learned counsel for the petitioner would submit that the petitioner is absolute owner of the property to an extent of 6 cents in S.No.96/1B in Athiyur Village & Group, Thiruvadanai Taluk and when the Panchayat attempted to lay a road, the case was instituted before the District Munsif-cumJudicial Magistrate, Thiruvadanai and the matter was settled https://hcservices.ecourts.gov.in/hcservices/

before the National Lok Adalat held on 12.04.2014. Recording the undertaking of the President of the Panchayat, Block Development Officer and District Collector that they would not make an attempt to lay a road in the property of the petitioner.

3.It is further submitted that when the petitioner wanted to construct a compound Wall to his property, the same was objected by the respondents 2 to 4 and therefore, the petitioner made a complaint to the first respondent on 06.06.2016 seeking police protection and the same was not considered by the first respondent police, the petitioner has filed this petition.

4.Heard the learned Government Advocate(Crl.side). 5.Considering the facts and circumstances of the case, the first respondent police is directed to give police protection to the petitioner at the cost of the petitioner. 6.With the above observation, this Criminal Original Petition is disposed of.
