To call for the records pertaining to the judgment passed in S.C.No.352 of 2009 dated 17.05.2011 by the Hon'ble Mahila Court, Tirunelveli and set aside the same acquiting the allellant and allow Criminal Appeal.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.V.SASIKUMAR, Advocate for the petitioner and of MR.CHANDRASEKARAN, Additional Public Prosector on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to condone the petitioner's absence for reporting before the Learned District Munsif Cum Judicial Magistrate, Sivagiri on the first working day of every month from April 2018 to July 2018 in Crl.M.P.No.1 of 2011 in Crl.A.No.195 of 2011 on 25.07.2011.
2.On the side of the petitioner, it is stated that the petitioner is abiding the condition from 25.07.2011 onwards till 02.04.2018. When the petitioner approached the learned Judicial https://hcservices.ecourts.gov.in/hcservices/
Magistrate on 02.04.2018, he was informed that the note book, in which he has signed is missing and till now the note was not traced out and the petitioner was not able to signed before the learned Judicial Magistrate and prayed his absence to be condoned. 3.On the side of the prosecution, it is admitted that the petitioner is regularly abiding the condition without fail till 02.04.2018.
4.In these circumstances, this Court deems it fit to condone the absence of the petitioner and to relax the condition and the petitioner is directed to co-operate with the Court till the disposal of the main case.
