For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 21 of 2021 on the file of the respondent Police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of I.P.C. and Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.21 of 2021 on the file of the respondent police, seeks anticipatory bail.

3.This is the second anticipatory bail petition. Earlier the petitioner was granted anticipatory bail in Crl.O.P.(MD)No.4697 of 2021 on 24.02.2021. However, it appears that the petitioner has not complied with conditions imposed in the anticipatory bail petition. The petitioner also filed Crl.M.P.(MD)No.3560 of 2021 for extension of time. Though the same was also allowed, the petitioner did not comply with same. Now the petitioner has come up with the second anticipatory bail petition for the same offence. https://hcservices.ecourts.gov.in/hcservices/

4.The learned counsel for the petitioner submitted that he was not able to comply with the directions in the earlier anticipatory bail petition and he also filed a petition for extension of time and that the petition was returned by the Registry. When this Court enquired as to whether he informed during mentioning time that his petition for extension of time was returned by the Registry, he was not able to give satisfactory answer.

5.Considering the fact that the second anticipatory bail petition is not maintainable when anticipatory bail was granted. Hence, this Court is not inclined to entertain this petition and the petition stands dismissed.
