Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the the 3rd respondent to allow the petitioner to shift his father, namely Ganapthi, aged about 55 years, admitted in Corona Ward No.207, Bed No.397 of 2nd respondent to take treatment from any of listed private Hospital for Covid - 19, in a time bound manner to be fixed by the Court.

ORDER

Heard the learned counsel on either side.

2.The petitioner's father, Thiru.Ganapathi, is suffering from COVID-19 and he is now taking treatment in the 3rd respondent hospital. The petitioner wants to shift his father to the Ragavendra Hospital, Madurai, which is said to be a listed private hospital.

3.The learned Additional Government Pleader informs this Court that the petitioner's father is being given a proper treatment. I am of the view that the choice must be given to the petitioner.

W.P.(MD) No.9925 of 2020 4.By directing the petitioner to shift his father to a private hospital, this Court is in no way casting any reflection on the functioning of the Government Rajaji Hospital, Madurai. Since the petitioner wants to shift his father, this Court is granting the relief. Therefore, even while accepting the report given by the 3rd respondent, this Writ Petition is allowed by permitting the petitioner to shift his father, Thiru.Ganapathi, to the Ragavendra Hospital, Madurai for further treatment.

5.The learned counsel for the petitioner also gives an undertaking that the petitioner would strictly obey the protocol that may be issued by the 3rd respondent. No costs.
