ORDER

The petitioner is the sole accused in Spl.S.C.No.31 of 2020 and he was found guilty and convicted and sentenced by the Special Court for POCSO Act Cases, Nagercoil, Kanyakumari, by Judgment dated 26.03.2024.

2. This Court, while suspending the sentence on 12.02.2025 in Crl.M.P.(MD) No.626 of 2025, directed the petitioner to stay at Tiruppur and report before the Inspector of Police, Tiruppur South Police Station, Tiruppur, daily at 10.30 a.m. till the disposal of the appeal. Now, this petition has been filed to relax the said condition.

3. The learned counsel appearing for the petitioner submits that the petitioner is regularly appearing before the Tiruppur South Police as directed by this Court and complying with the condition. Now, the petitioner has suffered paralysis attack and he lost his movement in the left hand. The learned counsel has also produced CT scan report and the Doctor's report. He further submits that the marriage of the petitioner's daughter is to be held on tomorrow.

4. The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that the petitioner is regularly complying with the condition from 21.02.2025.

5. Considering the fact that the petitioner has suffered paralysis attack and he 2/4

is regularly complying with the condition from 21.02.2025, this Court is inclined to modify the condition imposed in Crl.M.P.(MD)No.626 of 2025.

6. Accordingly, this petition is allowed and the condition is modified to the effect that the petitioner shall appear before the trial Court once in a month, i.e. on the first working day of every English Calender month at 10.30 a.m., till the disposal of the appeal. The petitioner shall file an undertaking affidavit before the respondent Police that he will not disturb the victim child at any point of time.
