ORDER : The Court made the following order :- The petitioners/A1 and A2, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 417, 420, 294(b) and 506(i) of IPC, in Crime No.3 of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioners are the husband and wife and they are running finance company in the name and style of Cendur Fincorp Finance Limited at Trichy. The petitioners approached the defacto complainant and asked to deposit money in their company and assured to give 5-10% profit and submitted that they would return the money after two years. Believing their words, the defacto complainant gave Rs.25 Lakhs from March-2018 to April-2019 and his relatives also deposited amount in that company. The petitioners issued cheque to them. CRL OP(MD). No.7123 of 2023 the tune of Rs.4,07,30,000/-. The cheque was also returned as 'closed'. Hence, the complaint.
3. Heard both sides and perused the materials available on record including the First Information Report.
4. It is seen that the petitioner received huge deposits to the tune of Rs.4,07,30,000/- from 216 victims. They also assured to return the same by double amount. Therefore, this Court is not inclined to grant anticipatory bail to the petitioners and the custodial interrogation of the petitioners is very much required.
