O R D E R

This Writ Petition has been filed to direct the official respondents 1 to 3 to give permission for Kaliyamman Temple festival scheduled on 11.04.2025 and 12.04.2025, situated at Indira Colony Street, Y.Kodikulam Madurai East Taluk, Madurai District and consider his representation, dated 28.03.2025.

2.According to the petitioner, the Kaliyamman Temple is belongs to the village namely Y.Kodikulam. The villagers have decided to conduct festival on 11.04.2025 and 12.04.2025. In this regard, they have approached the 3rd respondent to grant permission by way of representation, dated 28.03.2025, but the same has not been considered. Hence this petition.

3.The learned Government Advocate appearing for the respondents 1 and 2 would submit that there is a rival claim over the right of the temple. In this regard, they have already conducted a meeting and in the meeting, the parties have not settled their disputes. In order to avoid law and order problem, they have decided to lock and seal the temple. If both parties agreed to conduct the festival in a peaceful 2/6

manner and without any law and order problem, they will consider the representation of the petitioner.

4.The learned Additional Public Prosecutor appearing for the 3rd respondent police would submit that since there is a dispute between the petitioner and the 4th respondent, the petitioner's party have decided to conduct festival, by excluding the 4th respondent. Already, the matter has been forwarded to the revenue authorities and they have also conducted peace committee meeting. There is no amicable settlement made between the parties, in order to avoid law and order problem, the revenue authorities have decided to lock and seal the temple. If both parties agreed to conduct the festival in a peaceful manner, without any law and order problem, they will consider the representation of the petitioner. 5.Considering the limited scope of the prayer sought for in this petition, this Court, without even issuing notice to the private respondent, is inclined to pass orders.

6.The prayer of the petitioner is to conduct festival on 11.04.2025 and 12.04.2025 at Kaliyamman Temple, situated at Indira Colony Street, 3/6

Y.Kodikulam Madurai East Taluk, Madurai District. According to the respondents, they have conducted a peace committee meeting and since there is no amicable settlement made between the parties, in order to avoid law and order problem, they have decided to lock and seal the temple. Now, the petitioner has sent a representation on 28.03.2025 to grant permission.

7.In view of the above, the respondents 1 and 2 are directed to conduct a peace committee meeting based on the representation of the petitioner, dated 28.03.2025 and after affording opportunities to both parties, pass favourable orders, if both parties agreed to conduct the festival in a peaceful manner, without law and order problem. 8.With the above observations and directions, this Writ Petition is disposed of.
