consequently direct the 2nd respondent restore the earlier building plan approval issued in favour of petitioner vide f.cupik.vz;. 57/2020-2021 on 19.11.2020.

Prayer in W.P(MD)No.9048 of 2022: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order vide Na.Ka.No.370/2021 dated 19.04.2022 passed by the 2nd respondent and consequently restrain the respondents and their agents by an order of permanent injunction from demolishing construction raised by the petitioner in the property bearing 5/2N2, in Thisiyanvilai Village, In both cases:

ORDER

W.P(MD)No.10545 of 2021 has been filed for the following relief: "to call for the records relating to the impugned revocation of a building approval vide Na.Ka.No.57/2020 dated

24.05.2021 passed by the 2nd respondent, quash the same and consequently direct the 2nd respondent restore the earlier building plan approval issued in favour of petitioner vide f.cupik.vz;. 57/2020-2021 on 19.11.2020."

2. W.P(MD)No.9048 of 2022 has been filed for the following relief:

"To call for the records relating to the impugned order vide Na.Ka.No.370/2021 dated 19.04.2022 passed by the 2nd respondent and consequently restrain the respondents and their agents by an order of permanent injunction from demolishing construction raised by the petitioner in the property bearing 5/2N2, in Thisiyanvilai Village, Tirunelveli District."

3. Since the matter is sub judice in A.S.No.65 of 2019 on the file of III Additional District Court, Tirunelveli, the impugned order cannot be given effect to till such time as the finality arrived in A.S.No.65 of 2019. It is needless to state that subject to the ultimate result of A.S.No.65 of

2019, it is open to the petitioner to revive his request to challenge the impugned orders.

4. In view of the above, both the Writ Petitions stand disposed of. No costs.
