PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.153 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/Accused Nos.1 & 2 who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 500, 501, 502, 341, 294(b), 506(2), 195A, 4A (1a) of IPC in Crime No.153 of 2022 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the defacto complainant is running a medical shop in Body Town. The first petitioner is the 'Reporter' of monthly magazine by name, Police Express. The petitioners are demanding money from the defacto complainant for not publishing the bogus news, as if, he has been selling bogus medicines. Hence, the defacto complainant lodged a complaint against the petitioners and the same is pending trial before the Judicial Magistrate, Bodinayakkanur.

CRL OP(MD). No.9287 of 2022 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocents and they have not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioners. 4.The learned Additional Public Prosecutor appearing for the respondent police would state that five previous cases are pending as against the first petitioner and seven previous cases are pending as against the second petitioner. Hence, he strongly opposed to grant anticipatory bail to the petitioners.

5.Taking into consideration the facts and circumstances of the case and also taking note of the fact that five previous cases are pending against the first petitioner and seven previous cases are pending against the second petitioner, this Court is not inclined to grant anticipatory bail to the petitioners.
