PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 10.05.2022 and to forbear the respondents from opening of the proposed New TASMAC Shop in Narpavalaukkudi Village, Kovilkottai, Sengamari, Aranthangi Taluk, Pudukkottai District. 3. By consent of parties, the writ petition itself is taken up for final disposal.
4. This writ petition has been filed for a Mandamus seeking for a direction to the respondents to consider the petitioner's representation dated 10.05.2022, to forbear the respondents from opening of the proposed New TASMAC Shop in Narpavalaukkudi Village, Kovilkottai, Sengamari, Aranthangi Taluk, Pudukkottai District.
5. The learned standing counsel appearing for the third respondent on instructions, would submit that as on date, there is no proposal to put up a TASMAC shop in the afore mentioned address as alleged by the petitioner. He would also submit that as and when there is any such proposal, the petitioner's representation dated 10.05.2022, will be considered on merits and in accordance with law by the respondents.
6. After recording the submissions made by the learned standing counsel appearing for the third respondent, this writ petition is disposed of by directing the first respondent to consider the petitioner's representation dated 10.05.2022 as and when there is a proposal to open a TASMAC shop in Narpavalaukkudi Village, Kovilkottai, Sengamari, Aranthangi Taluk, Pudukkottai District, within a period of eight weeks from the date of such proposal, after affording a fair hearing to the petitioner.
