ORDER

This Writ Petition has been filed by the petitioner for issuance of Writ of Mandamus directing the respondent to conduct public auction and to open sealed tender(s) in respect of Item No.13 in the Notification published by the respondent in Na.Ka.No.25308/2014/A4 dated Nil.01.2015, forthwith and to declare the successful tenderer without further delay.

2. Heard the learned Counsel for the petitioner and the learned Counsel for the respondent.

3. Today, when the matter is taken up for hearing, the learned Counsel appearing for the respondent brought to the notice of this Court that fresh auction has been fixed on 27.03.2015 and the necessary Gazette Notification has also been produced. The learned Counsel for the petitioner would submit that the petitioner will participate in the new auction.

4. In view of the above the petitioner is permitted to participate in the new auction.

5. Accordingly, this Writ Petition is closed. Consequently, the connected Miscellaneous Petition is also closed. No costs. Sd/- Assistant Registrar (T&P) /True copy/ Sub Assistant Registrar To The Commissioner, Pudukkottai Municipality, Pudukkottai.
