Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, forbearing the respondent from passing final orders based on the exparte enquiry report and consequently direct the respondent to conduct de-nova enquiry after providing the documents as required by the Petitioner and permit him to produce the witnesses on behalf of him.

ORDER

When the petitioner herein had also challenged the charge memo dated 10.06.2021, this Court had directed the Disciplinary Authority to conclude the proceedings within a period of three months. The petitioner has not challenged this order. In the present Writ Petition, the petitioner now seeks for issuance of Writ of Mandamus forbearing the respondent from passing the final order. Since this Court had earlier ordered the Disciplinary Authority to conclude the proceedings within a stipulated time, the present Writ Petition seeking to forbear the respondent from passing the final order cannot be maintained.
