ORDER : The Court Made the following order :- The petitioners, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 498(A), 506(i) IPC and Section 4 of the Tamilnadu Prohibition of Harassment of Women Act in Crime No.Not Known of 2018, seek anticipatory bail.
2.Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. Side) appearing for the respondent Police.
3.First Information Report is yet to be registered. The learned counsel appearing for the petitioners on instructions from the petitioners submitted that husband shall pay a sum of Rs.4,000/- every month to the defacto complainant/C.Nagarani. 4.The learned counsel for the defacto complainant is directed to furnish the bank details of the defacto complainant. The first petitioner undertakes to deposit a sum of Rs.4,000/- every month https://hcservices.ecourts.gov.in/hcservices/
towards maintenance of the wife. It is only an interim arrangement. It is hope that the parties are resolve their differences. 5.Recording the undertaking given by the first petitioner, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Vadasandur, Dindigul District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
