PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime Nos.1083, 1104, 1127 of 2021 on the file of the respondent police.

COMMON ORDER : The Court made the following order :- The petitioner/Accused, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 457 and 380 IPC in Crime Nos.1083, 1104, 1127 of 2021, on the file of the respondent police, seeks anticipatory bail. 2.The petitioner is facing the charges in all the cases, for the offences punishable under Sections 457 and 380 of IPC.

3. It is stated by the petitioner that he is running a Gold Testing shop at Ariyalur. The accused persons have pledged the theft jewels at his shop and he was not aware that the said jewels were theft jewels. Based on the confession of the co-accused, the petitioner was falsely implicated in this case. https://hcservices.ecourts.gov.in/hcservices/ 1/2

4.The learned counsel appearing for the petitioners would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. Hence, he prayed for grant of anticipatory bail to the petitioner.

5.The learned Additional Public Prosecutor appearing for the respondent police would state that this is the second application for anticipatory bail and earlier, this Court, vide order dated 03.01.2022, made in Crl.O.P(MD)Nos.19307 to 19309 of 2021, dismissed the anticipatory bail applications filed by the petitioner.

6. A perusal of the order dated 03.01.2022 would show that this Court while dismissing the applications observed that granting anticipatory bail to this petitioner, will cause hindrance to the investigation process and the offence of such nature requires proper investigation that too by taking custodial interrogation. In the opinion of this Court that there is no change of circumstances in this case.
