For Respondent : Mr.K.Suyambulinga Bharathi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.181 of 2017 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner who is arrayed as A-1 apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of IPC, in Crime No.181 of 2017 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is arrayed as A-1. The petitioner said to have stolen High Tension Cable for the value of Rs.40,000/-(Rupees Forty Thousand Only) and the crime has been registered in the year 2017.

4. The learned counsel appearing for the petitioner would submit that he has not involved in the offence as alleged by the prosecution. Hence, he seeks anticipatory bail.

5. The learned Government Advocate (criminal side)appearing for the respondent police would submit that since the petitioner was absconding from the year 2017 now this petition has been filed seeking anticipatory bail. He would further submit that the petitioner is a habitual offender and that there are Eight cases are pending against him in similar offence.

6. Taking note of the submission of the learned Government Advocate (criminal side) and considering the fact that the petitioner is a habitual offender and that there are Eight previous cases are pending against him in similar offence and that the petitioner was absconding from the year 2017, hence, this Court is not inclined to grant anticipatory bail.

7. Accordingly, the Criminal Original Petition stands dismissed.
