Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of IPC, in Crime No.302 of 2016, on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and the defacto complainant entered into an agreement for renovation of his old house, but the petitioner did not complete the work within the time specified in the agreement. On complaint, case has been registered for the above said offences.

3.The case of the petitioner is that the petitioner has completed 90% of the work as agreed and for electrical work, the petitioner sent Electrician and at that time, some wordy quarrel arose between the Electrician and the defacto complainant. Due to that, the defacto complainant did not allow the Electrician and Plumber to do the work and subsequently, he has given a false complaint against the petitioner.

4.The learned counsel for the petitioner submitted that the petitioner is ready to complete the work.

5.Heard the learned Government Advocate (Crl.Side). 6.Considering the facts of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Kovilpatti and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a https://hcservices.ecourts.gov.in/hcservices/

like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
