ORDER

The present petition has been filed seeking to quash the charge sheet in C.C.No.455 of 2024 on the file of the Additional Mahila Court, Theni, which arise out of FIR in Crime No.381 of 2024 on the file of the first respondent police.

2. A perusal of charge sheet reveals that the petitioner has been charged under Section 296(b) 115(2), 351(2) of BNS Act and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002.

3. According to the petitioner, Section 4 of the Tamilnadu Prohibition of Harassment of Women Act, 2002, has not been attracted.

4. Harassment is defined under Section 2(a) of the Act. Section 2(a) of the Act is extracted as follows:

"Harassment means any indecent conduct or act by a man which causes or is likely to cause intimidation, fear, shame or embarrassment to a woman, including abusing, causing hurt or nuisance to such woman."

5. A perusal of the charge sheet reveals that the petitioner is alleged to have abused the wife of the second respondent and he had also pushed her down and caused minor injuries to her.

In view of the specific overt act attributed by the petitioner as against the wife of the second respondent, this Court is of the considered opinion that the defenses raised by the petitioner could be considered only at the time of trial and no grounds have been made out to quash the charge sheet. Hence, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed. 02.03.2026 TTA 1.The Inspector of Police, Theni Police Station, Theni District.
