To Condone the delay of 988 days in preferring Cross Objection in CMA(MD). No.452 of 2023, on the file of this Court which was filed against the order and decree of the MCOP No.1283 of 2018 on the file of the Motor Accident Claims Tribunal, (4th Additional District Court), Madurai dated 18.04.2022 in the interest of justice and thereby render justice.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed to condone the delay of 988 days in preferring Cross Objection in CMA(MD). No.452 of 2023, on the file of this Court, which was filed against the order and decree made in MCOP No.1283 of 2018 on the file of the Motor Accident Claims Tribunal, (4th Additional District Court), Madurai dated 18.04.2022.

2. Heard the learned counsel on either side.

3. Considering the reasons assigned in the affidavit filed in support of the petition, this petition is allowed and delay is condoned.

4. Registry is directed to number the petition, if it is otherwise in order and is further directed to post the main case for final hearing on 11.06.2026. In the meantime, Registry is directed to call for the original records from the concerned Court.

5. It is made clear that for the entire period of delay, th petitioner will not be entitled to claim the interest.
