ORDER

Heard Mr. M.Thirunavukkarasu, Learned Counsel for the Petitioner and perused the materials placed on record, apart from the pleading of the parties.

This Civil Revision Petition under Article 227 of the Constitution of India has been filed to expedite the disposal in I.A. No. 127 of 2015 in unnumbered Appeal Suit on the file of the Sub-Court, Srivilliputhur (hereinafter referred to as 'the Appellate Court' for short). 3.

This Court, during earlier hearing on 30.04.2024, had passed the following order:- "2.

The Sub-Judge, Srivilliputhur shall send a report as to whether there is any impediment for conducting 2/6

further proceedings in I.A. No. 127 of 2015 in unnumbered Appeal Suit and if so, explain the reasons for the same, before the next hearing."

In furtherance to the said order, the Trial Court has sent a report dated 24.05.2024, which reads as follows:- "I most humbly submit that I.A. No. 127/2015 in Unnumbered Appeal Suit on the file of this Court was filed by the petitioners along with I.A. No. 128/2015 to implead the legal representatives of the deceased 3rd appellant as proposed appellants 6 to 9 and it was allowed by this Court on 15.12.2021. Subsequently the consequential amendment petition under Order 6 Rule 17 CPC was filed in I.A. No. 1/2022 and the same was allowed by this Court on 19.01.2023. Now the above I.A. No. 127/2015 is pending to carryout amendment in the petition and for filing the amended petition copy and it is posted on 20.06.2024.

I humbly submit that there is no impediment for conducting further proceedings in the above I.A. No. 127/2015 in the Unnumbered Appeal Suit.

I humbly submit that I undertake to dispose the above I.A. No. 127/2015 within a period of one month."

Having regard to the contents of the said report, the learned Sub Judge, Srivilliputhur, shall dispose the I.A.No.127 of 2015 in A.S.No.unnumbered of 2014, within a period of one year from the date of receipt of a copy of this order.

In the result, the Civil Revision Petition is disposed on the aforesaid terms. No costs.
