..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned order/de-affiliation order in file no. DGT-Aff011(47)/2/2022-O/o DIR(TC) dated 17.01.2025 issued by the 1st respondent and quash the same and consequently direct the 1st respondent to regularize the trades/units of the petitioner institution as per recommendation order issued vide DGT-Aff011/5/2024-O/o DIR (TC) dated 30.07.2024 within a stipulated period.

ORDER
The petitioner challenges the order dated 17.01.2025 issued by the first respondent, whereby the trades/units of Government and Private Industrial Training Institutes (ITIs) that had 100% vacant seats continuously for the period from 2018 to 2023 were de-affiliated, including the petitioner institution.

2.The petitioner institution was established on 01.07.1993 with the object of imparting technical education and training to students. According to the petitioner, adequate admissions were made to the courses offered by the institution until the outbreak of the COVID-19 pandemic. However, during the academic years 2020-2021 to 20232024, admissions could not be made due to the pandemic. 3.Thereafter, the petitioner submitted applications to the first and second respondents seeking permission to admit students from the academic year 2024-2025 onwards. Pursuant thereto, the second respondent constituted an inspection committee on 21.02.2024 to inspect the petitioner institution and other similarly placed institutions.
After inspection, the committee submitted a report recommending that permission be granted to the petitioner to admit students from the academic year 2024-2025 onwards. Based on the said recommendation, the petitioner resumed admissions. It is thereafter that the impugned order came to be passed. 4.Learned counsel for the petitioner submitted that the impugned order has been passed without affording any opportunity to the petitioner to explain its position.
2019 and 2019-2020 and that admissions could not be made only during the COVID-19 period. It was further submitted that, after obtaining permission from the respondents, the petitioner resumed admissions from the academic year 2024-2025 onwards. Therefore, the impugned order is arbitrary and violative of the principles of natural justice.
5.Per contra, the learned counsel appearing for respondents 1 and 2 submitted that the petitioner had admitted only 8 students against a sanctioned strength of 100 seats for the academic year 2024-2025 and only 7 students against a sanctioned strength of 88 seats for the academic year 2025-2026. Therefore, according to the respondents, the petitioner institution does not have adequate student strength and the impugned order does not warrant interference. 6.The submissions made on either side have been considered. 7.The impugned order proceeds on the premise that no admissions were made by the petitioner during the period from 2018 to 2023. However, the materials placed before this Court indicate that students were admitted during the academic years 2018-2019 and 2019-2020 and that admissions were not made only during the 4/7
COVID-19 pandemic period. It is also not in dispute that, pursuant to the recommendation of the inspection committee, the petitioner was permitted to resume admissions from the academic year 2024-2025 onwards.
8.Further, the impugned order is a common order de-affiliating several Government and Private ITIs. Admittedly, no notice was issued to the petitioner and no opportunity was afforded to explain why the institution should not be de-affiliated. In the facts of the present case, the action of the respondents in passing the impugned order without hearing the petitioner is arbitrary and violative of the principles of natural justice. Therefore, the impugned order, insofar as it relates to the petitioner institution, cannot be sustained. 9.Accordingly, the writ petition is allowed and the impugned order dated 17.01.2025, insofar as it relates to the petitioner institution, is set aside.
10.The petitioner is directed to submit a representation to respondents 1 and 2 within a period of one week from the date of receipt of a copy of this order. Upon receipt of such representation, the respondents shall consider the same on its own merits and pass 5/7
appropriate orders in accordance with law within a period of three weeks thereafter.
11.There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
