PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the learned Sessions Judge, Special Court for Trial of Cases registered under SC/ST (POA) Act, Tenkasi, to consider the bail application to be filed by the petitioner on the same day of its filing on his surrendering in connection with the case in crime No.107 of 2026, on the file of the Inspector of Police, Achanputhur Police Station, Tenkasi District. 1/4

ORDER

The present petition has been filed by the sole accused in crime No.107 of 2026 on the file of the second respondent police seeking a direction as against the trial Court to consider the bail application of the petitioner on the same day of the surrender.

2. Considering the averments in the petition, there shall be a direction to the learned Sessions Judge, Special Court for trial of cases under SC/ST (POA) Act, Tenkasi, to consider the bail application of the petitioner on the same day of the surrender in crime No.107 of 2026 on the file of the second respondent police after giving due opportunity to the defacto complainant.

3. With the above said observations, this Criminal Original Petition stands allowed.
