O R D E R
This petition has been filed seeking a direction to the second respondent and their officials not to harass the petitioner and not to interfere in the civil dispute between the petitioner with the third respondent regarding pathway in O.S.No.62 of 2021 pending on the file of the District Munsif Court, Vadipatti.
2. When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that enquiry in CSR No.363 of 2021 has been closed on 30.07.2021. For circulating the copy of the same, the matter is listed today. A copy of the closure report has been circulated to this Court. It has been sated that an enquiry on the basis of the complaint given by the third respondent has been undertaken and during the course of enquiry it was found that in respect of the property dispute between the parties, a suit in O.S.No.62 of 2001 is pending before the District Munsif, Vadipatti. Advising the parties to work out their remedy before the concerned court in which the suit is pending, the petition came to be closed. https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.8904 of 2021 The petitioner has also given a statement and undertaking to the effect that they will abide and follow the judgment in the judgment in the aforesaid pending matter.
3. Since the complaint has been closed, nothing survives for consideration in this petition and interference by the second respondent into civil dispute may not arise.
4. Recording the submission of the learned Additional Public Prosecutor that the complaint has been closed, this petition is disposed of.
