PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records in the impugned order passed by the third respondent in vide Order No.24/ podhu /PIPS/ 2022, dated 28.04.2022 and to quash the same and directing the respondents to grant permission and protection for the "Cock Fight" in Arulmigu Sri Muthumariyamman Temple Festival at Batlagundu, Nilakottai Taluk, Dindigul District from 26.05.2022 to 28.05.2022. (Order of the Court was made by ABDUL QUDDHOSE, J.) The petitioner has challenged the rejection order dated 28.04.2022 rejecting his request for grant of permission to 1/3
conduct "Cock Fight" in Arulmigu Sri Muthumariyamman Temple Festival at Batlagundu, Nilakottai Taluk, Dindigul District from 26.05.2022 to 28.05.2022.
2. Mr.S.Ravi, learned Additional Public Prosecutor accepts notice on behalf of the respondents.
3. The learned Additional Public Prosecutor appearing for the respondents has placed before this Court an order dated 11.01.2022 passed by the Division Bench of this Court in W.P(MD)No.476 of 2022 involving the very same issue.
4. The Division Bench in the afore said order has granted interim injunction restraining the respondents from granting permission for "Cock Fights" in the State pending disposal of W.P (MD)No.476 of 2022.
5. In view of the same, the learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition and seeks liberty to file fresh writ petition as and when the interim order granted by the Division Bench of this Court on 11.01.2022, stands vacated.
6. Accordingly, this writ petition is disposed of by granting liberty to the petitioner to file fresh writ petition as and when the interim order dated 11.01.2022 passed by the Division Bench in W.P(MD)No.476 of 2022, stands vacated. No Costs. Consequently, connected Miscellaneous Petition is closed.
