Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to revoke the suspension order dated 27.09.2019, based on the enquiry report dated 12.05.2021, with a consequential direction directing the respondents 1 to 3 to disburse all monetary and terminal benefits to the petitioner, within the time frame fixed by this Court. The petitioner has filed this writ petition seeking for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to revoke the suspension order dated 27.09.2019, based on the enquiry report dated 12.05.2021 and consequently directing the respondents 1 to 3 to disburse all monetary and terminal benefits to him.

2. Heard Mrs.K.Porkodi, learned counsel appearing for the petitioner and Mr.K.S.Selvaganesan, learned Additional Government Pleader appearing for the respondents.

3. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

4. The petitioner, who was working as a Co-operative SubRegistrar/Field Officer at Kamuthi, was suspended from service on the basis of a charge framed against him alleging that he had failed to properly verify the list of beneficiaries for Co-operative Loan Waiver Scheme.

5. Mrs.K.Porkodi, learned counsel appearing for the petitioner would submit that an enquiry officer was appointed in the domestic enquiry and detailed report has been filed by the enquiry officer on 12.05.2021, stating that the charge framed against the petitioner was not 3/6

proved. Despite the same, the order of suspension was not revoked. Hence, the petitioner has given a representation to the respondents 1 to 3 on 14.02.2024, seeking to revoke the order of suspension. But, so far no order has been passed.

In view of the said reason, there shall be a direction to the third respondent to consider the representation of the petitioner dated 14.02.2024 and pass orders to revoke the order of suspension, on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. No costs.
