O R D E R

This writ petition has been filed seeking Writ of Mandamus, directing the 1st respondent to consider and dispose of the petitioner's representation dated 13.02.2026 and direct the 1st respondent to credit the petitioner's monthly pension amount to his Savings Bank Account.

According to the learned Counsel appearing for the petitioner, the petitioner, who was employed as a Conductor in the first respondent Transport Corporation, retired from service on 30.11.2025 as a Special Grade Conductor. Thereafter, his pension has been credited to the savings account maintained by him with the second respondent bank. However, according to the petitioner, without his consent and in the absence of any loan agreement, the second respondent bank has falsely created a housing loan entry in his name and claiming that his property has been mortgaged. Consequently, the bank is not permitting the petitioner to withdraw the amounts credited to his savings bank account. 2/6

Under those circumstances, the petitioner claims to have submitted a representation to the first respondent, requesting that his pension be credited to the savings bank account maintained by him with the third respondent bank. Complaining of the non-consideration of the said representation, the petitioner has approached this Court by filing the present writ petition.

4. The learned counsel appearing for the second respondent contended that the petitioner has suffered decrees at the instance of the second respondent Bank in O.S. No.882 of 2020 dated 02.06.2025 on the file of the Additional Sub Judge, Dindigul, and in O.S. No.748 of 2020 dated 26.04.2023 on the file of the Additional Subordinate Court, Dindigul. In the said decrees, it has been held that the plaintiff/bank is entitled to recover sums of Rs. 5,68,020/- and Rs.5,94,168/- respectively. It is further submitted that certain other civil suits are also pending against the petitioner for recovery of amounts. Be that as it may, if the second respondent has any monetary claim against the petitioner, it is always open to the second respondent bank to proceed against the petitioner in accordance with law. However, insofar as the request of the 3/6

petitioner to credit the pension payable by the first respondent to the savings bank account maintained by him with the third respondent is concerned, the second respondent cannot stand in the way.

5. The learned counsel appearing for the first respondent submitted that the first respondent would consider the representation dated 13.02.2026 submitted by the petitioner in accordance with law and pass appropriate orders thereon.

In the light of the above, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's representation dated 13.02.2026, in accordance with law, and pass appropriate orders within a period of three weeks from the date of receipt of a copy of this order. No costs.
