For Respondent : Mr.M.Chandra Sekaran, Additional Public Prosecutor PETITION FOR BAIL Under Sec.438 of Cr.P.C PRAYER :- For Bail in Crime No. 12 of 2019 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A1 herein was arrested and remanded to judicial custody on 19.08.2019 for the alleged offences under Section 395 r/w Section 397 of IPC, in Crime No.12 of 2019 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the defacto complainant is the driver of taxi. On the date of occurrence, the petitioner and other accused persons approached the defacto complainant for travelling to Tenkasi to Sayalkudi. Hence, the defacto complainant took the accused persons towards Sayalkudi, at that time, the petitioner and other accused persons said to have forcibly snatched mobile phone, cash of Rs.4,500/- and indica car from the defacto complainant by showing knife. Hence, the present complaint. 3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.9024 of 2020 implicated in this case. Hence, he prayed for grant of bail to the petitioner.

4.The learned Additional Public Prosecutor appearing for the respondent Police submitted that the petitioner is having sixteen previous cases of similar in nature.

5.Considering the facts and circumstances of the case and also considering the fact that there are sixteen previous cases pending against the petitioner of similar in nature and the petitioner is a habitual offender, I am not inclined to grant bail to the petitioner.
