O R D E R
The petitioner, a depositor, is before this Court seeking issuance of a writ of mandamus directing the respondent to take action in terms of Sections 4(3) and 7 of the Tamil Nadu Protection of Interests of Depositors (in Financial Establishments) Act, 1997.
2. An order of attachment under Section 3 of the Act has been passed by the Government vide G.O. (4D) Nos. 97 dated 23.06.2025 and 186 dated 07.10.2025 against the properties of M/s. Sree Geethanjali Auto Financiers, in which the petitioner is one of the depositors. The said company has failed to return the deposit made by the petitioner. The grievance of the petitioner is that, despite the attachment orders passed by the Government, the respondent has not taken steps to make the attachment absolute, as contemplated under Section 4(3) of the Act.
3. Mr. M. Lingadurai, learned Special Government Pleader, who accepts notice on behalf of the respondent, on instructions, submitted that appropriate orders will be passed by the respondent under Section 4(3) of 2/4
the Act. The said submission is taken on record.
4. In view of the above, the writ petition is disposed of with a direction to the respondent to take appropriate steps under Section 4(3) of the Act within a period of four (4) weeks from the date of receipt of a copy of this order.
5. There shall be no order as to costs.
