Prayer : Criminal Original Petition filed under Section 582 of BNSS, 2023, to issue a direction to the 3rd respondent police not to harass the petitioner and his family members under the guise of an enquiry based on a false counter complaint or to compel a compromise in respect of the petitioner's complaint dated 21.03.2026 and the pending civil suit in O.S.No.216 of 2025 on the file of the Principal Subordinate Court, Kumbakonam.

ORDER
The petitioner has approached this Court that the respondent police is harassing him under the guise of investigation. 2.Learned Counsel for the petitioner submits that in a land dispute, he was assaulted and he has lodged a complaint and without enquiring the complaint by receiving a counter complaint, the police officials are harassing the petitioner.
3. The learned Government Advocate(crl.side) appearing for the respondents submits that the petitioner has lodged a complaint and the same was treated in C.S.R.No.172 of 2026. A counter compliant was also lodged as against the petitioner. The same was treated as a Petition Enquiry in C.S.R.No. 171 of 2026. Both these complaints were lodged on 01.03.2026 and the respondents police have conducted the investigation, they found that there was a land dispute between the petitioner and the other opposite party and a civil dispute is also pending.

4. During the enquiry, the petitioner and the counter party have given a statement that they would not precipitate the issue and they would work out the remedy based on the outcome of the civil suit. Therefore, the respondent police have closed both the complaints, registered and enquired in CSR Nos.171 and 172 of 2026.
5. According to the learned Government Advocate(crl.side), as on date, there is no complaint pending as against the petitioner and they are not harassing the petitioner.
6. Recording the submissions of the learned Government Advocate(crl.side), this Criminal Original Petition stands closed. 10.04.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
