PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned circular Na.Ka.No.AD2/4175/ 2014 dated 10.03.2015 issued by the second respondent and quash the same and consequently directing the second respondent to absorb the petitioner as Driver to Drive Heavy Vehicles at the second respondent Department. For Petitioner :Mr.R.Murugappan For Respondents :Mr.D.Mayarajan Standing Counsel.

ORDER

Mr.D.Mayarajan, learned Standing Counsel takes notice for the respondents and by consent of both the parties, the main writ petition itself is taken up for final disposal at the stage of admission.

2. Heard the learned Counsel appearing for the petitioner and the learned Standing Counsel Pleader appearing for the respondents.

3. The petitioner is challenging the communication dated 10.03.2015, issued by the second respondent wherein and whereby, the second respondent has called upon the employees working under the respondents Corporation and having heavy vehicle driving license to make application for appointment to the post of Heavy Vehicle Driver.

4. It is stated that the petitioner is working from 2009 onwards on temporary basis as a Heavy Vehicle Driver and he has also made an application on 17.03.2015, in pursuant to the said impugned communication.

5. The learned Standing Counsel appearing for the respondents Corporation submitted that the petitioner is entitled to take part in the selection process.

6. The apprehension of the petitioner is that he may not be considered since he is working as temporary employee.

7.I do not think that the apprehension of the petitioner is well founded in view of the fact that the very communication calling upon all the employees working in the respondents Corporation to make such application who are having the requisite qualification would mean that the petitioner is also entitled to apply if the petitioner is having the requisite qualification.

The learned Counsel appearing for the respondents submitted that the petitioner can also take part in the selection process.

8. Accordingly, I find that the grievance of the petitioner is not well founded. Consequently, the writ petition is disposed of with the above observations as stated supra. Consequently, the connected Miscellaneous petitions are closed.
