O R D E R

The sixth defendant in the suit is the Revision petitioner. He filed I.A.No.42 of 2018 for filing his additional written statement. But the Court below declined to grant leave to file such an additional written statement. Questioning the said order of rejection, this Civil Revision petition has been filed.

2. When the matter was taken up for hearing, the learned counsel appearing for the plaintiff informs that the suit itself has been disposed of, because the Revision petitioner herein remained ex-parte. He produced a photocopy of the Judgment and Decree dated 25.04.2018, whereby, the declaration sought for was granted and preliminary decree was also granted.

3. In view of the same, the Civil Revision petition is closed as infructuous. Liberty is given to the Revision petitioner for restoration of this Civil Revision petition, in the event of revival of the suit. No costs. Consequently, connected Miscellaneous petition is closed.
