Criminal Revision Case filed under Section 397 r/w 401 of the Code Criminal Procedure against the order passed by the Chief Judicial Magistrate Court(Special Court for P.C.Act Cases), Tirunelveli in Crl.M.P.No.385 of 2015 in Special S.C.No.58 of 2014 on 21.01.2016.

ORDER:

This Petition coming on for hearing on this day, upon perusing the earlier order of this Court, and the requisition letter submitted by the Chief Judicial Magistrate Court(Special Court for P.C.Act Cases) Tirunelveli vide letter in D.No.241 of 2018 dated 14.11.2018 and upon hearing the arguments of Mr.G.Marimuthu, Advocate for the Petitioner and of Mr.M.Chandra sekar, Additional Public Prosecutor, on behalf of the respondent, this Court made the following order:

This petition has been listed today for extension of time. By order dated 24.07.2017, in Crl.R.C.(MD)No.437 of 2016, this Court had directed the trial Court in Spl.S.C.No.58 of 2014 within a period of six months from the date of receipt of a copy of the order.

2.Now the learned Special Judge (FAC), Special Court for Trial of cases under prevention of Corruption Act, Tirunelveli has sent a communication dated 14.11.2018 seeking three months time for disposing the Spl.S.C.No.58 of 2014. Hence, the matter was listed today.

https://hcservices.ecourts.gov.in/hcservices/ 3.The learned Additional Public Prosecutor submitted that the trial was begun and out of 55 witnesses, 38 witnesses were examined.

4.The request made by the learned Special Judge (FAC), Special Court for Trial of cases under prevention of Corruption Act, Tirunelveli is rejected. However, in order to give fair opportunity to both the parties to conclude the trial, the prosecution is directed to produce the witnesses on day today basis and both the parties are directed to co-operate for completing the trial and to dispose the case within a period of three months. Therefore, the learned Special Judge (FAC), Special Court for Trial of cases under prevention of Corruption Act, Tirunelveli is directed to conduct the trial on day today basis and dispose the case within a period of three months from today, without any further delay.
