Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner/Accused No.4, apprehending arrest at the hands of the respondent police for the offences punishable under Section 420 of IPC in Crime No.592 of 2016, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent. 3.The petitioner is figuring as fourth accused. It is seen that the A1 to A3 had approached the complainant Bank and try to pledge fake jewels. The said persons were caught during the commission of the act itself. They made a statement that the fake jewels were given by the petitioner herein.
4.The counsel for the petitioner submits that there is a dispute between the petitioner and the Jewel appraiser of the Bank. He also points that he has nothing to do with A1 and A3. FIR was registered in the year 2016. The petitioner was not absconding till date and not arrested by the police.
5.Taking account all these circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain other conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/
released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.V, Tirunelveli and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
