For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 172 of 2023 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehend arrest at the hands of the respondent Police for the offences punishable under Sections 294(b), 323,379(NH) and 506(i) of IPC r/w.section 4 of TNPHW Act in Crime No.172 of 2023 on the file of the respondent Police, seeks anticipatory bail.

2.The case of the prosecution is that on 11.04.2023 at about 1.30 pm., the petitioner quarreled with the defacto complainant and abused him in filthy language and also attacked with hands and harassed one Sumathi who is working as a school teacher and also threatened the defacto complainant. Hence, the complaint.

3. Heard both side and perused the materials available on record including the First Information Report.

4. The learned counsel for the intervenor/ defacto complainant appeared before this Court showing a video.

No.7214 of 2023 5.On seeing the video it is revealed that the petitioner had trespassed into the school and attacked the Head Master in front of the students and he also scolded him in filthy language. Further the petitioner is the Correspondent of the School and he is running a aided school in which the victim was working as a Head Master. Though there were several issues created by the petitioner he also refused to pay the salary to the victim for the past several months. The victim being the school Headmaster he was attacked by the petitioner in front of the students, which would create bad example amoung the students. Further the petitioner acted as rowdy and trespassed into the school and attacked the victim therefore custodial interrogation of the petitioner is very much required in this case, hence this Court is not inclined to grant bail to the petitioner.

5. Hence the petition stands dismissed.
