ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 174 of Cr.P.C., in Crime No.312 of 2021, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant is the wife of the deceased/Murugan. It appears that the deceased borrowed money from the accused. On 20.06.2021, at about 7.00 a.m., in the morning, all the three accused including this petitioner, had come to the house of the defacto complainant and threatened her husband to pay the amount lent to him with interest and her husband told that because of Corona , he was not able to work and pay the amount. The accused threatened to pay within two days. Unable to bear the torture, the deceased had left the house. Later, at about 11.30 am., he was found dead by hanging at Vaguthumailai, Unan Utthu. 3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is falsely implicated in this case.
4.The learned Government Advocate (criminal side) opposed this petition on the ground that this case is registered on 22.06.2021 and the investigation in this case is preliminary stage and therefore opposed to grant anticipatory bail to the petitioner. 5.The allegation against this petitioner and other accused that they had threatened the deceased, unless he pays the money due the accused, they would kill him. Therefore, the deceased committed suicide. The First Information Report registered in this case only on 22.06.2021 and the investigation is initial stage, therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
