ORDER : The Court made the following order :- The petitioners/A3 and A4, who apprehend arrest at the hands of the respondent Police for the offences punishable under Sections 379 of IPC and section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.192 of 2023 on the file of the respondent Police, seek anticipatory bail.
2.The case of the prosecution as per the de-facto complainant, is that the petitioners said to have illegally transported one unit of river sand. Hence, the complaint.
3.Heard both side and perused the materials available on record including the First Information Report.
4.Taking into consideration of the fact that the previous bad antecedents of the petitioners and also the fact that there is no change in circumstances of the case even after dismissal of the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.7378 of 2023 earlier petition, this court is not inclined to grant anticipatory bail to the petitioners.
5.Hence the petition stands dismissed.
