RESPONDENTS/RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 121 days for preferring the Civil Miscellaneous appeal before Motor Vehicle Accident Claims Tribunal / Chief Judicial Magistrate Court, Ramanathapuram in MCOP No.33 of 2013 on 06.12.2017 and thus render justice.

PRAYER IN CMA(MD)NO.SR26483 of 2018 set aside the Judgment and decree passed by motor Vehicle Accident Claims Tribunal / Chief Judicial Magtistrate court, Ramanathapuram in M.C.O.P NO.33 of 2013 on 06.12.2017 and allow this Civil Miscellaneous Appeal and thus render justice. ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.H.VELAVADHAS, Advocate for the petitioner and of 2nd respondent not appeared either in person or by an Advocate, the court made the following order:- 2.The learned counsel appearing for the petitioner submitted that the Tribunal granted compensation directing the second respondent to pay the amount to the petitioner. In view of the same, the first respondent is not necessary party.

3.Though second respondent entered appearance through counsel, today,there is no representation 3.Considering the contention of the learned counsel for the petitioner/s,the delay of 121 days is condoned on payment of cost of Rs.500/-(Rupees Five hundred only) to the Rojavanam, Homeless & Aged https://hcservices.ecourts.gov.in/hcservices/

Care Centre, Melur Road, Uthangudi, Madurai, Within a period of two weeks from the date of receipt of a copy of this order, failing which, this petition shall stands dismissed automatically, without further reference to this court.
