Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to promote the petitioner to the post of Assistant General Manager of the third respondent bank with effect from 29.01.2013 on par with the juniors of the petitioner and to pay all attendant benefits.

*********** This writ petition has been filed by the petitioner seeking promotion to the post of Assistant General Manager of the third respondent Bank with effect from 29.01.2013 on par with the juniors of the petitioner and to pay all attendant benefits. https://hcservices.ecourts.gov.in/hcservices/ 2.The second respondent filed counter affidavit in this writ petition. In the meanwhile, the second respondent passed an

order, dated 06.10.2016 promoting the petitioner as Assistant General Manager (In-charge), in the Head Quarters of the said Bank and his salary has been fixed as 18800-925/19-36375 (1+19 Stages). 3.The learned counsel appearing for the second respondent would submit that since the promotion has already been given to the petitioner, the writ petition has become infructuous and seeks dismissal of the writ petition.

4.The petitioner counsel would submit that he might be given liberty to challenge the said order, if there is any discrepency while fixing his salary.

5.In view of the above submission, the writ petition is dismissed. If the petitioner is aggrieved by any of the fixation of pay or any difference regarding the date of enforcement of said promotion and attendant benefits, he is at liberty to challenge the same. No costs. Consequently, connected M.Ps are closed.
