ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to survey the petitioner's properties and fix boundary stones in respect of Survey No.448, measuring an extent of 1 Acre and 49 Cents, and Survey No.449, measuring an extent of 7 Cents, totalling 1 Acre and 56 Cents, situated at Thulukkapatti Village, Sathur Taluk, Virudhunagar District, under the supervision of the fourth respondent, in accordance with the petitioner's representation dated 06.01.2025, within a time frame to be stipulated by this Court.

The learned counsel for the petitioner submits that the petitioner is the owner of the properties comprised in Survey Nos.448 (1 Acre and 49 Cents) and 449 (7 Cents), totalling 1 Acre and 56 Cents, situated at Thulukkapatti Village, Sathur Taluk, Virudhunagar District. Despite repeated requests, the official respondents have not surveyed the land or fixed boundary stones. The petitioner made a representation dated 06.01.2025 requesting the survey and demarcation of boundaries under the supervision of the fourth respondent. Since the same has not been considered so far, the petitioner has approached this Court by filing the present Writ Petition seeking a direction to the respondents to survey the land and fix boundary stones within a time frame to be stipulated by this Court.
3. The learned counsel appearing for the fifth respondent submits that the petitioner does not hold a Patta and is not the rightful owner of the subject property. However, the petitioner claims ownership and has submitted a representation seeking conduct of a survey.
4. On the other hand, the learned Government Advocate appearing for the respondents 1 to 3 submits that, after conducting an enquiry and recording the
objections on either side, the second respondent / Tahsildar shall consider the petitioner's representation and pass appropriate orders on merits and in accordance with law, within a time frame to be fixed by this Court.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation 06.01.2025, on merits and pass appropriate orders in accordance with law after providing reasonable opportunity of hearing to the petitioner, the fifth respondent and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
