Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondent and their men, agents not to collect current consumption charges, demand charges, and any arrears from the petitioner for the consumption in HTSC No. 059094760055 connected to the 5th Respondent, till the payment of entire outstanding dues of Rs.2,84,834/- due towards payments for the unutilized units of energy generated by the petitioners WEG bearing HTSC No.079224722750 connected to the 4th Respondent, along with interest at 1 percent per month, until the said amount is either paid or adjusted in full by the Respondents. 2. The petitioner is before this Court seeking a direction to the respondents forbearing them from collecting current consumption charges, demand charges, and any arrears from the petitioner for the consumption in HTSC No. 059094760055. Petitioner claims to a captive power generator and supplied energy to the TANGEDCO and a certain amount is due to the TANGEDCO and without adjusting the said amount, the respondents are demanding payment of monthly consumption charges for the stock.
3. Mr.S.Deenadhayalan, learned counsel appearing for TANGEDCO submitted that if any amount is due to the petitioner, the same shall be adjusted towards the consumption charges.
4. The said submission is taken on record.
5. This Writ Petition is disposed of directing the first respondent to adjust the amount, if any, due to the petitioner from the consumption charges to be paid by the petitioner in relation to the said service connection. If the petitioner is found entitled for the amount on account of supply of energy to the respondent, the same shall be deducted from the monthly consumption charges 3/6
