O R D E R

The petitioner is before this Court seeking issuance of a writ of mandamus directing respondents 2 and 3 to implement the order passed by the first respondent dated 02.01.2026.

The second respondent, in exercise of powers under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, by order dated 13.02.2021, directed the fourth respondent to pay a sum of Rs.5,000/- per month towards maintenance to the petitioner. The petitioner states that the said order was challenged by the fourth respondent before the first respondent. The first respondent, by order dated 21.12.2024, dismissed the appeal.

3. Since the fourth respondent failed to comply with the order 2/5

passed by the second respondent, the petitioner approached the first respondent seeking implementation of the said order. The first respondent, by communication dated 02.01.2026, directed the second respondent to implement the order either by recovering the arrears of maintenance or by initiating penal action against the fourth respondent. The grievance of the petitioner is that the second respondent has not acted upon the said communication till date.

4. Mr. D. Sadiq Raja, learned Additional Government Pleader, who accepts notice on behalf of the official respondents, on instructions, submitted that the communication dated 02.01.2026 issued by the first respondent will be acted upon in accordance with law by respondents 2 and 3. The said submission is placed on record.

5. In view of the above, the writ petition is disposed of with a direction to respondents 2 and 3 to implement the communication dated 02.01.2026 in Na.Ka. C/e-4127633/2024 issued by the first respondent, in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.

6. There shall be no order as to costs.
