The present writ petition has been filed for a Writ of Certiorari to quash the impugned proceedings in R.C.No.00852/B3/2026, dated 24.03.2026 of the third respondent.

2. The petitioner has joined in service as Secondary Grade Teacher and now, she is working as Head Mistress of Vellathevanviduthi Panchayat Union Primary School from 01.01.2026 onwards. The petitioner has completed 27 years of service. The petitioner was awarded with several awards. However, when the petitioner had participated in a dance competition in a marriage hall, the petitioner was imposed with suspension order. Hence, the petitioner is seeking revocation of suspension.

3. The learned Additional Government Pleader for the respondents vehemently objects for the revocation of suspension stating that the petitioner has performed dance in a political party event. As per the Rules and Regulations, a Government employee should not participate in any political event. Therefore, the third respondent has suspended the petitioner and has produced the photographs, wherein the photos show the petitioner dancing in front stage and behind therein a banner of a political party with its header's picture.

The contention of the learned counsel appearing for the petitioner is that on that date, three functions were organised in the same place, viz., marriage, political party event and women's day celebration. The petitioner claims that she participated in the dance competition conducted on the women's day celebration.

5. When the respondents are having power to initiate disciplinary action, they are at liberty to proceed with the same. As far as the suspension in the present case is concerned, the suspension is unnecessary. Therefore, the respondents are directed to revoke the 3/5

suspension and reinstate the petitioner into service forthwith and the respondents are at liberty to proceed with the disciplinary proceedings.
